Motor vehicle collisions can cause profound distress and even change the course of a victim's life, leaving behind financial strains, physical and emotional harm, and ongoing stress. Of course, filing an accident claim […]
DePuy Orthopedics, a company that manufactures, among other products, hip replacements, has been ordered to pay in excess of $8 million to a plaintiff who brought a lawsuit alleging that the products were defective. Cases against the company have alleged that debris from the hip replacement devices has cause bone damage in some patients. According to these cases, this has sometimes resulted in patients losing bone tissue and suffering a great deal of pain and anguish.
When a defective product claim wins, it is good news for other people who have filed similar claims. These claims are sometimes bundled together in representative actions, where a few cases are selected that represent the same complaints that other plaintiffs have about the device in question. This speeds up the process of getting these cases heard.
Where medical devices are concerned, the damage that people suffer from them can be grievous. Whether it is a hip replacement that destroys bone tissue, leads on a pacemaker that cause unexpected shocks or any other problem, medical devices are sometimes extremely difficult to remove after they have been implanted. In some cases, removing the medical device is actually more dangerous than leaving it in the body, putting a patient in a lose/lose situation. This is where defective product attorney’s come in.
When someone has been injured by a product that was found to have been defective, a defective product lawyer can work to help them find a way to get compensation. Sometimes, a case has to be heard before it can be determined for sure that a product was defective, but even someone who has a new allegation against a product can seek out an attorney to represent them in court against the manufacturer of that product.
Filing a defective product claim will have to be on the grounds that the product was advertised, manufactured or designed improperly. The person filing the claim also has to have suffered some actual damage because of the defective product. For example, if you bought a product that was found to have been defective but never suffered an injury due to that product, it may be difficult for you to file a lawsuit. On the other hand, if you did purchase a product or have a device implanted in your body for a medical procedure and was later found out that the product was defective and you suffered an injury due to that defect, you may want to speak with a lawyer.
