As parents, we try to make sure our children have the toys they want in order to keep them sufficiently occupied and help them develop into healthy adults. In order to do this, we must be careful in our selection and be aware of any potential hazards ahead of time.
Unfortunately, many children are injured or killed each year due to defective and hazardous toys. Defective and unsafe products can cause serious and fatal injuries to infants and children. Manufacturers of these products can be held liable for damages and injuries inflicted on our children, but you need an experienced attorney on your side if you’re looking to take on a products liability case.
One of the most important things a parent can do is be informed in his or her selection of children’s toys. Product liability is a topic no one likes to discuss, but it is a necessary one when it comes to the safety of the toys with which children play. While there are government controls in place, manufacturing defects still occur. A person only needs to read the papers and see all the recalls that have resulted because of these manufacturing defects to understand how serious they can be.
Manufacturing defects are not the only defects we can expect to find in toys. Some toys are dangerous just by their design. Lawn darts is an obvious example of this type of “design defect.” There are many other toys that may fit into this category as well.
Marketing issues can also present a problem when it comes to keeping dangerous toys out of the hands of our children. In far too many cases, consumers do not receive adequate warnings or instructions about the dangers of certain toys. For instance, instructions do not often include the reasons toys are recommended for certain ages. There is also the problem of the use of dangerous chemicals without warning.
What happens to dangerous toys? Those that are known to cause injuries are subjected to recall. Take Buckyballs for instance. Buckyballs are a magnetic toy that is actually marketed for adults but can be rather dangerous if children come in contact with them due to internal hazards if swallowed. Dunecraft has recalled its expand-in-water “Water Balz” – also because of potential hazards if swallowed. Other toys have been recalled because of dangerous chemicals that were used during the manufacturing process, especially many that have come to the United States from other countries (more common with toys coming from China).
