Nail Gun Injuries

Has a defective nail gun or lack of on-the-job training led to a serious injury? Our Dallas personal injury lawyers can help.

Nail guns have been available to both the industrial sectors and general public since 1959. While they can also be referred to as cartridge compression guns or powder-actuated tools, their primary function is to fire nails into various materials such as wood, masonry, steel and concrete.

In most cases, nail gun injuries are the result of improper use by the user as well as failure to follow the safety requirements for nail gun use required by OSHA. Many times, these accidents can be attributed to the lack of training provided by the victim's employer. Sometimes these accidents are even the result of a defective nail gun.

The cause and effect.

According to statistics from the U.S. Center for Disease Control and Prevention, between 2001 and 2005, approximately 37,000 nail gun injuries occurred on a yearly basis. They further state that nail gun injuries have increased approximately 200 percent since 1991.

Why such a major increase? The CDC believes the increase is possibility the result of an increase in the availability of cheap consumer-grade pneumatic nail guns and air compressors. While they have no statistics on sales, their research into who was getting injured proved that work-related nail gun injuries had remained steady since 1998, while injuries among consumers were the ones that had increased.

The injuries which result from a nail gun accident can range from minor puncture wounds to serious injuries leading to nerve damage and infection, and can even result in wrongful death.

Nail guns and product liability.

While there are certainly cases that are due to user error, one commonly-overlooked cause is the product itself. A manufacturing defect may have affected the dual action firing system that operates the nail gun, leading to a misfire. Studies have shown that this particular element of design is at least partially responsible for a number of nail gun injuries.

Anyone who has been injured as the result of a defective or dangerous nail gun must understand that a product liability lawsuit is separate from a workers’ compensation claim.
