Most of us seldom question whether or not the items we buy regularly are risk-free. Unfortunately, many consumer goods are incorrectly designed, manufactured, or marketed. These blunders might result in serious harm or […]
Bed rails (AKA side rails) serve an important purpose in nursing homes as well as in hospitals. They limit movement when it comes to at-risk patients, and they serve as an easy way of making sure that patients are kept safe from falling from their bed. That being said, many elderly individuals have been injured or killed as a result of bed rail entrapment due to improper use, outdated products, or inadequate supervision.
Back in 1995, the FDA issued a warning regarding the risks posed by bed rails and bed rail confinement. This came after numerous cases of elderly individuals in nursing homes getting trapped in-between the bed's side-rail and mattress, or between the gaps of separated bedrails.
Due to the frailty of most nursing home patients, this confinement would be akin to a strong grip which could lead to constriction of blood vessels, lacerations, fractures, strangulations, frustration and agitation on the part of the trapped patient which may in turn make them more likely to self-harm in an attempt to get free.
Some nursing homes have been known to be negligent, especially in relation to providing the best amenities for their patients. It’s not uncommon for these homes to keep using outdated bed models due to the mistaken rationalization that buying a new one won’t make a difference. It is this attitude that leads to needless deaths due to bed rail confinement. The FDA has done a lot to ensure that these institutions adhere to safety regulations, including releasing guides in 1995 and 2010 in an attempt to make these facilities aware of the importance of bedrail safety.
Our law firm knows too well how these cases can change the lives of families forever. Our Dallas law firm was able to successfully negotiate a $1.2 million settlement for a family whose mother was killed after becoming entrapped in the bed rail, all the while suffering the effects of Alzheimer’s.
