In December we covered a Jefferson County medical malpractice case in which a Southeast Texas woman is suing her doctor after a botched tubal ligation surgery (commonly known as getting your tubes tied). The woman claims in her lawsuit that she became pregnant with her fourth child just months after the tubal ligation, which was supposed to prevent future pregnancies.

The woman is suing her doctor for impaired ability to earn income, physical impairment, physical disfigurement, deterioration of physical and mental condition, medical costs, and exemplary damages.
When a woman becomes pregnant after a tubal ligation, it may be for a number of different reasons. In some cases, the tubes may naturally grow back together, while in other cases, a woman may not follow the post-operative rules and become pregnant from resuming sexual intercourse too soon after the procedure. In other cases, however, a tubal ligation pregnancy may take place because of doctor malpractice or medical negligence. In these last cases, a woman may sue her gynecologist for wrongful birth. Not only does wrongful birth mean that a woman and her family must raise an initially unwanted child, it also means that the woman may suffer financial hardships, medical complications, and career stumbling blocks.
In addition, tubal ligation medical malpractice and pregnancy after a tubal ligation can lead to serious complications, including birth defects, very dangerous tubal pregnancies, complications during birth or abortion, and emotional distress.
