Car Accidents and Police Reports in Texas

Do I need a police report after a car accident in Texas?

The first few days after a car accident can be painful, frustrating, and downright confusing. Insurance adjusters are asking questions, medical bills are piling up, and you may not know what to do next.

Police Accident Report

Police accident reports are not immediately available to the public, and many municipalities require you to request them in person (which may be difficult if you’ve been injured). Some municipalities such as Farmers Branch, Texas will not even respond to the scene of an accident unless there is an injury – leaving you with no police report at all.

Steps to take after an accident.

To begin with, always exchange information with the other driver(s) if possible. If you’re injured, you need to call for medical assistance immediately. If possible, you may collect evidence at the accident scene by taking photos as well as witness contact information. You should do these things regardless if the police arrive at the scene or not.

Police reports may not be admissible in court.

Police reports are often not admissible in court due to hearsay. These crash reports may contain factual inaccuracies due to the fact that police officers aren’t trained car accident investigators or reconstructionists. Additionally, police reports can even hurt your chances of getting justice if any information in them paints you in a negative light.
By contacting an experienced Dallas car accident law firm, you’ll have a much higher chance of winning your case. Your attorney can obtain your police accident report as soon as it’s available, and law firms usually have the needed resources to carry out extensive investigations. Additionally, car accident attorneys have years of experience when it comes to dealing with such occurrences, giving them an upper hand compared to the police.
Don’t want to pay a lawyer to investigate your case? You don’t have to… It’s FREE! Most car accident lawyers (including Rasansky Law Firm) work on what’s called “contingency.” This means you don’t have to pay ANYTHING unless we win your case for you. If we win you money, your attorney takes a percentage of the award, but you are never charged for time spent on your case, copies, investigation, etc.

Do NOT sign anything.

Lastly, please don’t sign anything before speaking to your attorney. Insurance companies are in the business of cutting costs by all means necessary, so it’s not uncommon for them to approach you and ask you questions or ask you to sign a piece of paper. Doing so may jeopardize your chances of getting compensation because these documents may bar you from filing a lawsuit. It’s shady, unethical, and just plain wrong, but it’s what happens and you need to be aware.
