The lawsuit alleges that the child suffered a brachial plexus injury. This type of injury can lead to paralysis of the arm, which the infant allegedly did suffer. According to the lawsuit, the injury was suffered in 2008 and the lawsuit itself was filed in January of this year.
The type of injury the infant suffered occurs when the shoulder is pulled downward and the head is pulled upward. This causes a particular type of nerve injury that can result in a condition called Erb’s palsy. This condition is characterized by paralysis of the arm, which the lawsuit alleges that the child does suffer with.
The lawsuit was filed against the doctor responsible for the delivery and the medical center where the child was born. Like many medical malpractice lawsuits, this one alleges that the child was not given adequate care. Birth injuries and the lawsuits that sometimes follow them oftentimes arise because a doctor gave improper care, did not give necessary care when it was needed or took another negligent action or inaction that resulted in the child being harmed.
