I Was Just in a Wreck, Now What?

Laws regarding how to handle the aftermath of a wreck differ from state to state. For instance, some states ask that you remain at the site of the accident while others ask that, if at all possible, you should pull over to the next exit or even on to the shoulder. Always call in immediately after a wreck to make sure you're doing the right thing.

Reporting a wreck.

When you call in, make sure to ask whether or not you need to wait on a police officer. Some states require a police report regarding the accident, however, in many states a police report is only necessary depending on the amount of money that is involved with the wreck or if someone was injured.
Regardless of whether or not contacting the police is required, it is always best to report the accident. The documentation of the wreck can potentially help your case if you decide to call a motor vehicle accident lawyer and sue for damages.

Insurance.

Whether or not you call your insurance company right away is up to you, but there are situations where you may want to put it off until you contact an attorney. If it's obvious that their was negligence on the other driver's part you may want to wait and contact an attorney first. Some examples include:

  • The driver was on a cell phone
  • The driver was drunk
  • The driver was not paying attention to the road
  • The driver ran a stop sign

These are all cases where you may want to have a car accident lawyer prepare a lawsuit for you. It may be advisable to talk to a lawyer first before speaking with your insurance company. Your lawyer will be able to guide you in the process of increasing the chance that the insurance company will pay your claim.
