The legal steps for car accident lawsuit actions may involve a bit more than you'd think at first. These lawsuits sometimes take some time to resolve. The statute of limitations regards how long you have to file a claim. Once the claim is filed, it could take a year or more before the case is resolved. After your lawyer decides to take you on, they start formally putting together your case. This is the phase where your lawyer gets your case together. If the defendant you're suing decides to make an offer to settle, your attorney will work with you to come up with a suitable amount. It may be less than you're suing for, but the advantage is that you don't have to pay for court fees or the other costs of going to trial. If the defendant fails to offer a reasonable settlement, however, the case will proceed.

Trial

If your case goes to trial, your attorney will argue your claim in front of a jury and seek and award from them. There is no guarantee that you'll win your claim. If you do, the jury may award you the amount you're seeking or a lesser amount, depending upon their determination regarding the merits of your claim.
