Nursing Home Negligence

Negligence in a nursing home can lead to serious injury or death. Our attorneys can hold the nursing home responsible.

As the American population ages, more and more people are moving into nursing homes and assisted living facilities to be cared for by professionals.  Many families spend a great deal of time trying to find the highest-quality facility for their loved one, never imagining that they could be putting their relative into a dangerous situation. Our Texas nursing home neglect attorneys want you to be aware of the warning signs of neglect.

Abuse, neglect and exploitation are all unacceptable problems in the nursing home and assisted living industry, and every family should be vigilant for signs and symptoms indicating that abuse could be taking place.  If you suspect that someone you love is being victimized by a caregiver, don't hesitate to take action - you could very well save your loved one's life.  Take steps to ensure your loved one is out of harms way and then call a nursing home negligence lawyer today.

There are a number of different ways that nursing home residents can be hurt.  Physical, sexual or emotional abuse, financial exploitation, or neglect and abandonment can all happen at any time, resulting in serious injury or death.  Here are some signs of elder abuse and/or neglect:

  • Bedsores (or decubitus ulcers) - especially advanced ones - can indicate neglect.
  • Bruises, cuts, burns, fractures or sprains that appear with no explanation or an assortment of injuries in various stages of healing can indicate a pattern of physical abuse.
  • Falls from a bed or entrapment in bed rails or side rails should not happen in a properly supervised facility.
  • Frozen joints could mean a resident was neglected and not moved.
  • Torn, stained or bloody underclothing can be a sign of sexual abuse, as can unexplained sexually-transmitted diseases (as well as irrational behavior or mood changes or depressive or despondent behavior).
  • Failure to recognize or treat a stroke, heart attack or other medical condition or failure to get a resident to the hospital in time to be treated are all forms of negligence.
  • Staff who refuse to allow visitors, intentionally delay visits or refuse to allow residents to be alone with visitors may have something to hide.
  • Abuse could be an issue if a resident exhibits a sudden unexplained change in behavior (i.e. becoming depressed, withdrawn or violent).
  • Medication being used faster than expected or not being used frequently enough can indicate neglect.
  • Missing possessions, mysterious ATM withdrawals or bank transfers, or changes in financial documents like wills or beneficiary designations can be a sign of financial abuse.
