If you've been in a car wreck, there are sometimes situations that result from it that could be very bad for you. Aside from the obvious financial and medical problems that may result, the other driver may make things even worse for you on the legal side. In some cases, if you're in an accident with a commercial vehicle such as a semi, the company that owns the vehicle may try to persuade you to give up your rights to pursue compensation.
A settlement, if it's a good one, is something that an attorney helps you to negotiate with a party that you've decided to sue. In some cases, commercial firms will approach you with an offer to give you compensation in exchange for not suing. There are some serious issues with this type of an arrangement. Most of the time, you'll be offered such a payment if the party that caused the wreck thinks that you'd win a court case. Consider the following:
Never take one of these checks before you speak with an attorney. Most any Dallas car wreck lawyer will be willing to meet with you for a free consultation, so go ahead and call them and explain that you've been offered a payout from a company that you believed was responsible for an accident that you were in. The attorney may advise you to go ahead and file a lawsuit instead of taking the check.
This usually will not be an issue with commercial firms. Other drivers, however, may become belligerent and may start throwing threats at you. They may threaten to sue, for instance. Remember that threats are just words. If they had an attorney, the attorney would certainly be telling them to stop calling you and threatening you! Still, these drivers can be difficult to deal with and, sometimes, their bluster is just an attempt to cover up their own negligence in regard to the accident.
Contact a Dallas car accident attorney if you feel that you've been wronged, no matter how much the other driver is making a pain of themselves. If you feel that you are in real danger from the other driver, however, make sure to contact the authorities and to report any threats you've received.
