According to the Southeast Texas Record, the lawsuit alleges that the driver involved did not keep a proper lookout, failed to apply brakes, didn’t control their speed, didn’t turn and didn’t maintain a proper distance, causing a rear end collision that three residents of Harris County have decided to sue over.
According to the report, the plaintiffs were driving on Interstate 10 – they were all in the same vehicle – and were struck from behind by a semi-tractor trailer. The lawsuit also alleges that there were either defective brakes or no brakes on the tractor-trailer at the time of the collision.
The lawsuit states that the plaintiffs didn’t do anything to bring the accident on themselves and, during the accident, the rear end collision sent their vehicle spinning and eventually their vehicle collided with the center divider on the highway. The lawsuit does claim that the plaintiffs were injured in the truck accident.
Many lawsuits involving transport companies allege that the transport company failed to maintain their vehicles as required. Obviously, where semi trucks are concerned, the stakes are much higher if the vehicles are not maintained than they are in situations where only passenger cars are involved. A semi truck without proper breaks or lacking in other areas becomes a genuine hazard to everyone on the road.
There are also sometimes issues with the equipment designed to provide for the safety of other drivers. For example, recent tests have shown that under-ride guards, a piece of equipment installed on the back end of a trailer to prevent cars from going underneath it, may not perform as well as manufacturers and trucking companies believed.
This collision, however, was a rear end collision, and the scenario depicted in the lawsuit is rather standard. Cars that are struck from behind oftentimes do end up being out of control and, in addition to the initial hit from behind, those vehicles oftentimes are involved in another collision that results from the driver losing control.
