A Texas couple has joined a number of families around the country in filing a birth injury and defective drug lawsuit against a pharmaceutical drug company that they believe is responsible for their child’s birth defect.
Texas resident Holly Rorick was taking the prescription antidepressant Zoloft when she became pregnant. When she asked her doctor about the safety of the drug to her unborn baby, she was told that it was safe for both her and her baby. Months later, Rorick gave birth to her daughter Abigail, who suffered from a number of heart-related birth defects that Rorick and her husband believe was caused by the drug. The couple also believes that the maker of the antidepressant, Pfizer, knew the dangers of the drug to fetuses and kept that information from the public.
The lawsuit was filed on June 14 in the District Court for the Southern District of Texas.
In Illinois, a different couple filed a similar lawsuit involving the birth of their twins, Ronan and Reece Ratliff. As in the Texas defective drug case, the mother of the children took Zoloft during her pregnancy after receiving the go-ahead from her physician. When her babies were born, they suffered a number of birth defects, including holes in the chambers of their hearts.
The couple is seeking unspecified damages for product liability, neglect, fraud, misrepresentation, and violation of consumer protection laws.
