Pileup Car Accidents in Texas

Pileup accidents, by definition, involve many vehicles which are all covered by different insurance policies. Waiting for the insurance companies to determine liability alone can take months, and any determinations will be likely be contested by multiple parties. Additionally, it may be determined that one driver was liable for causing multiple injuries, leading to issues where some victims are unable to recover any compensation at all.

Chain reaction car accidents are dangerous since they expose drivers to multiple opportunities for injury. Cars crashing into each other in a pileup can easily result in secondary injuries, and if an 18-wheeler truck fails to stop in time, the results are often deadly.

Determining fault in a multi-vehicle accident.

As previously mentioned, determining fault in a pileup accident is not an easy feat. This is because the police have to investigate the scene, question the affected drivers and write individual police reports which sometimes may conflict with each other given the subjective manner in which people see the world. In addition, insurance companies will need to carry out their independent investigations into the matter; something which may take a while.

If it's determined that multiple vehicles shared liability for the accident, you (or your attorney) will have to file a multiple claims. For example, one driver may be 40% at-fault, one at 25%, one at 20%, and another at 15%. Each claim will seek compensation proportional to their degree of liability, and you should expect each insurance company to put up a fight.

It’s thus not uncommon for people involved in these accidents to experience significant delays with regard to their insurance claims. Meanwhile, your medical bills are accumulating and you may be missing significant amounts of work; something that's often a source of great anxiety and financial stress.

As a car accident lawyer, our job is to help injured victims recover the money they're owed following a personal injury. It's all we do at Rasansky Law Firm, and we have an outstanding track record of success over the past 22 years. We believe you should be focused on recovering from your injuries following an accident; not fighting with the insurance company.

Policy limits often leave victims in the cold.

Texas law requires that every driver carry liability insurance, but the policy limits on these plans are often inadequate. For example, most liability policies in Texas provide only $25,000 in property damage liability (for ALL cars involved in the crash), and $60,000 in bodily injury liability (up to $30,000 per person, but with a limit of $60,000 total). While this may be fine for most minor car accidents, the same cannot be said for accidents involving multiple vehicles, and especially if there are any catastrophic injuries.

In addition, the compensation available is on a first-come-first-serve basis. Once policy limits have been exhausted, it basically locks out all the other victims when it comes to seeking compensation for their injuries and assorted damages. This is why it's always important to speak with an attorney as soon as possible after a wreck.

What to do after a pileup accident.

If you find yourself involved in a pileup accident in the future, there are a few things you should do. The danger of being hit again is always a possibility, so if you think the area is still dangerous, stay in your car and keep your seat belt on. Turn on your hazards to warn approaching drivers, and if you were hurt or you believe anyone else may have been injured, call 9-1-1 immediately.

Do not move your car, but if you're able to move a safe distance away from the vehicle (off the road), make sure to take pictures and video of the accident scene. Secondly, take down the contact information and insurance details of any and all involved drivers, as well as contact info for any witnesses. Wait for an officer to come to the scene and fill out a crash report, and report the accident to your insurance company.

If you were injured at all, its very important you speak to an attorney as soon as you're able to. Do not give a recorded statement to insurance without first consulting with a lawyer, as you could end up inadvertently harming your case. Remember that a recorded statement is for their benefit, not yours.

Given the complex nature of these type of auto accidents, it is important to at least discuss your options with a Dallas-Fort Worth car accident attorney as early as possible. If you'd like to learn how we can help you recover the compensation you deserve, call us today at (214) 651-6100 for a free and confidential consultation.
