In some cases, medical malpractice is defined by the missing of a diagnosis that should have been caught. Sometimes, patients end up suing doctors because the doctor missed a diagnosis and, because of having done so, reduced the patient's overall chances of survival. A recent case in Minnesota, relates the tale of a girl with a rare cancer of the muscles that was not diagnosed and how her parents are fighting in court to sue for medical malpractice.

In the worst-case scenarios, the lawyers end up arguing that the missed diagnosis actually ended up causing the client's death.
