It's not always easy to determine whether or not you need to contact a medical malpractice lawyer. This isn't always because of legal questions. Many people like their doctors and, in some cases, they've had the same doctor for many years. It's hard to consider going after someone with a lawsuit when we have some sense of loyalty to them. There are good reasons for you to consider filing a lawsuit, however, if the doctor has failed in their duties to you. Medical malpractice claims do not have to be expensive to have tried and there may be significant benefits in it for you.
One reason you may want to consider filing a claim is because medical malpractice liability, contrary to a lot of what is said in the media, actually helps to keep everyone's healthcare costs down. Medical lawsuits constitute a small fraction of the cost of healthcare in the US. The consequences of medical malpractice, however, most certainly cost a great deal of money. In some cases, patients may have to have a surgery done twice, they may have extended hospital stays or they may require a lifetime of care that they would not otherwise require were it not for the medical malpractice. The doctors should pay for that.
Another reason to consider pursuing one of these claims is the fact that you're going to pay for it one way or another. When the doctor fails in their duties to you, there are oftentimes very harsh financial consequences that follow. For example, you may be facing the aforementioned repeat surgery. Even though the hospital may try to make you feel like they're being generous by footing the bill for that surgery, they're not going to come forward and pay the costs of your lost wages or for your pain and suffering as a result of it.
A third reason you may want to consider filing one of these cases is simply because patients should have a reason to expect that they can trust their doctors expertise and in their dedication to their duties when they visit them. While everybody likes to think of their doctor as their friend, to some extent, they're actually professionals who have a job to do. Medical liability law exists to make sure doctors and hospitals understand that they are responsible when they don't live up to their duties.
