Many industries employ call center agents to take care of customer service related queries as well as carry out marketing campaigns. According to the country’s labor laws, these individuals should be paid for the total amount of time worked, including overtime.
Overtime is defined as any amount of time that the hourly worker spends carrying out work-related duties outside of his or her mandated 40 hour a week schedule. Overtime is calculated by taking the hourly pay and multiplying it by 1.5 for each hour worked. Unfortunately, some call center employers take advantage of their workers and refuse to pay them the wages they deserve as indicated by the Department of Labor.
Many employers do not respect labor laws when it comes to overtime pay - especially in the call center industry. Employers expect these workers to work overtime without receiving any additional payment. If any of the following apply to you, we recommend calling and speaking with an unpaid overtime lawyer right away.
In the past, there have been cases of unpaid overtime that were taken to court by employers of large companies such as Countrywide Home Loans and Convergys Corp. Call center agents who ended up winning these lawsuits were collectively awarded millions of dollars as compensation for unpaid wages.
If you believe that your employer is exploiting you by expecting you to work overtime and not receive adequate payment, you may be eligible for compensation. You may receive overtime payment going back a few years if the court discovers that your employer knew that what they were doing was illegal. Additionally, you may be able to sue for liquidated damages and attorney’s fees.
