Most of us seldom question whether or not the items we buy regularly are risk-free. Unfortunately, many consumer goods are incorrectly designed, manufactured, or marketed. These blunders might result in serious harm or […]
In most cases when a battery explodes, it is either the result of a physical damage or due to a defective product. Whether involving a cell phone, a laptop, an e-cigarette, etc, it is essential to make sure you have plenty of documentation to support your claims.
The requirements of modern economics make us exceedingly dependent upon power consumption. A major part of the mobile economy into which we have evolved is in the form of rechargeable batteries that use lithium-ion technology. While we might think these batteries are perfectly safe, the truth is that a manufacturing defect or defective design can caused these batteries to violently explode—often causing severe burns and other personal injuries.
One would think the technology would have been improved over the years to eliminate the problem, but unfortunately, as of yet there have been no major breakthroughs. In fact, the only thing we see are the same rechargeable battery cells in different packaging that has been diminished in size yet packaged more tightly. While this so-called improved technology makes the batteries more energy-dense, it also means when something goes wrong with the batteries, the result is more serious.
When a battery is not handled properly it can overheat. This causes the cells in the battery to burst and often leads to a chain reaction with other cells also rupturing. This is what causes most batter explosions or even simple battery swelling. This particular defect has the potential to result in a simple short circuit, but can often lead to a catastrophic failure. These type of battery malfunctions are the very reasons cell phones and laptops sometimes catch fire.
These type of batteries are often used in close proximity to the user, and thus, consumers expect them to be safe. If a consumer is injured by a defective battery, they expect to be compensated for their injuries and other losses. Unfortunately, these type of accidents occur far too frequently, and manufacturers are almost never willing to accept responsibility. That's where we come in.
Even if the battery failure was triggered by recent physical damage, you may have a valid claim if it can be proven that poor design allowed such reasonable damage to cause an explosion.
In March of 2013, a woman in southern California suffered second-degree burns on her buttocks, legs and hand after her e-cigarette battery exploded in her car after plugging her "VapCigs" brand battery charger into her car's cigarette lighter receptacle. The battery allegedly exploded, igniting both her dress and the seat of her car. The violent eruption also sprayed corrosive materials on her, causing lifelong scarring.
On September 30th, 2015, a Riverside jury awarded the woman $1.9 million for her product liability claim.
