Car Accident Resulting in a Broken Bone
Bone Fractures Caused by Car Crashes

There were over half a million reported car crashes last year in Texas alone, resulting in nearly 250,000 injuries. One of the most-common types of injuries sustained in an auto accident are broken bones. While some types of bone fractures are more-serious than others, all will require medical treatment (which doesn't come cheap).

Understand that the other driver's insurance company is not on your side, no matter how friendly they sound on the phone. Their job is to find a way to plausibly deny your claim, or at the very least, to severely undervalue your damages and reduce the potential value of your claim. At Rasansky Law Firm, our job is to advocate on your behalf, build a solid case, provide leverage, and give you the best chance at a successful settlement or jury award. It's all we do at Rasansky Law Firm, and we've helped countless people in your exact situation over the past 22 years.

Broken bones caused by car crashes.

Moments before an accident, the human body acts in a defensive manner by stiffening the arms, neck and legs. This can actually lead to more-serious injuries because an outstretched position makes it more-likely for bones to break.

There are four different types of bone fractures, including:

  1. Open fractures: These involve bones breaking and then piercing the skin, causing open wounds which may go on to be infected if they aren’t treated fast.
  2. Closed fractures: These injuries involve bones breaking and then remaining underneath the skin.
  3. Displaced fractures: These involve bones breaking in many different places and then moving to different areas in such a way that they are no longer aligned.
  4. Non-displaced fractures: These usually see bones breaking but remain in alignment.

It is important to note that most fractures occur to the arms, legs, ribs and the spine, as these are some of the largest bones and bone systems in the body. The backbone, made up of individual bones called the vertebra, is prone to twisting and being pulled in an unnatural manner at the time of impact. While not every spine injury results in paralysis, failing to seek treatment can lead to chronic back pain or worse.

If you experience numbness or tingling, extreme pain when moving, not being able to place your feet on the ground due to sharp pain, swelling or lingering pain in a limb, you need to be seen by a doctor as soon as possible. If you cannot afford to see a doctor, our firm may be able to help you receive treatment under what's called a letter of protection.

What you need to know about the insurance company.

While bone fractures are a somewhat-common type of injury, they can often result in lost wages, chronic pain, disfigurement, and decreased functionality. Insurance companies know this, and will oftentimes try to offer you a low-ball settlement before you're even done treating. They do this for two reasons:

  1. If they can get you to take the settlement offer, your claim is now closed and you can no longer seek any addition compensation. If you later discover that you'll require additional surgery, physical therapy, or simply have decreased functionality once the cast is removed, you have no legal recourse to pursue any additional compensation.
  2. If they can get you to propose a counter-offer, they now have you on record saying that you'll accept X amount to settle your claim. No matter what transpires afterward (e.g., you find out you'll need additional medical treatment, will need to miss work [lost wages], or can no longer perform your job [reduced earning capacity]), they have no reason to offer you more than your initial counter offer.

The point is that the insurance company has a huge advantage over you when you're not represented by an attorney, and if you don't know what you're doing, they WILL take advantage of you. They handle personal injury claims all day every day, yet this is likely the first injury claim you've ever had to make. Do not make the mistake of thinking you can take on the insurance company—and their team of lawyers—by yourself. The insurance company has no reason to fairly negotiate with an unrepresented claimant, and that's exactly why accident injury attorneys exist; to ensure that you are not taken advantage of, and to give you the best chance at recovering every penny you deserve.

Not everyone realizes that they can hire a personal injury attorney for no out of pocket cost, but it's true! At Rasansky Law Firm, we work on a contingency-fee basis. You pay absolutely nothing to hire us, and we only take a fee based on how much you actually receive at the end. If for whatever reason we're unable to win your case or negotiate a fair and agreeable settlement, you walk away without owing us a penny. We do not require a retainer, and we do not bill you for our time spent working on your case.
