These injuries usually require urgent medical attention. The legal statutes regarding dog bites can differ from one state to the next. But what many people do not know is that filing a lawsuit is often not necessary. The truth is, you may be able to simply file a claim against the dog owner’s homeowner’s insurance policy. Of course, the insurance company may still try to deny your claim or give you the runaround, so I still very-much recommend discussing your case with a dog bite lawyer before doing anything.

It’s the responsibility of dog owners to ensure that their dogs do not attack people. Most dog bite victims are children; because of this, parents need to teach their children how to behave around pets. I would also recommend never leaving young kids unattended in the presence of a dog which you do not trust with your child’s life.

A dog can be considered dangerous if any of the following apply:

  • They make an unprovoked attack on a person that causes bodily injury and the attack happens outside the dog’s enclosure.
  • The dog commits an unprovoked attack outside its enclosure causing a person to reasonably believe that the dog will attack and cause bodily injury

Some of the legal responsibilities that dog owners need to pay attention include:

  • Keeping the dog in a secure and fenced enclosure. This enclosure needs to be locked thus preventing access by members of the public.  The enclosure should also have a sign clearly marked stating if there’s a dangerous dog.
  • When a dog isn’t in its enclosure, it must be restrained using a leash at all times or in the vicinity of other people.
  • The dog owner may also be required to register the dog with the local animal control authority.
  • A dog owner must also maintain some form of liability insurance coverage to cover the damages that may arise from his or her dog attacking a person.
