According to the Southeast Texas Record, Southern Refrigerated Transport driver Cathy Guignet was traveling northbound on Highway 71 North near Marshall, Texas, when a truck traveling southbound jackknifed in the road and blocked her lane. She was not able to avoid a crash and slammed into the wrecked tractor-trailer. Both commercial vehicles caught on fire, seriously injuring Guignet and destroying the cargo of both vehicles.
Now, Guignet has filed a truck wreck lawsuit against both the driver of the other truck, Daryl Weaver, as well as his employer, East Clay Carriers. The personal injury lawsuit states that Weaver was tailgating a pickup truck and trailer in the moments before the accident and speeding before the crash – two traffic violations that he was ticketed for after the wreck.
Weaver is facing claims that he failed to control the speed of his truck, failed to stay in his lane, failed to apply the brakes, and failed to keep a proper look out. His trucking company is accused of negligent hiring, negligent supervision, and negligent training.
