Texas Scooter and Moped Laws

This month, we are talking about moped and scooter accidents as well as scooter accident prevention. Perhaps the best way to prevent moped and scooter crashes is to know Texas motorized scooter laws and follow all rules and regulations.
First and foremost, how does Texas define a motorized scooter? Under Texas law, any vehicle with a 50cc engine or less is considered a moped, while any scooter with an engine larger than 50cc is considered a motorcycle.

Texas moped laws (50cc engine or less):

• Scooter users must have a Class C Driver's License.
• Scooter registration is required.
• Scooter insurance is required.
• Your scooter must pass an inspection each year.
• Scooter helmets are required for all riders unless you take a safety course and prove you have health insurance coverage.
• Scooter riders must use a headlight at night and have rear reflectors.
• Scooters traveling slower than surrounding traffic should ride as far to the right shoulder as safely possible.

Texas motorcycle laws (for motorized scooters with more than a 50cc engine):

• All riders must hold a motorcycle license or motorcycle license endorsement – which requires a written test and a road test.
• Vehicle insurance and registration is required.
• Motorcycle helmets are required for all riders unless you take a safety course and prove you have health insurance coverage.
