Fatal Truck Accidents in Texas
After the loss of a loved one, your family may be entitled to compensation for some of the damages you face. In order to secure compensation, you must file a wrongful death claim against the responsible party.
In Texas, there are several parties who can be held liable for the losses you face following a truck accident. These parties generally include:
- The truck driver: If the driver of the truck was impaired, fatigued, speeding, or engaging in any other act of negligence, and their actions caused the crash, they can be held liable.
- The trucking company: Truck companies are required to vet drivers properly before onboarding them. If the truck company negligently hires drivers, it can be held liable.
- The maintenance company: If the crash resulted from negligent maintenance practices, the party responsible for performing the inspections or maintaining the vehicle can be held liable.
- The parts manufacturer: If the truck crash was caused by a malfunctioning or defective part, the company that created or offered the parts can be held liable.
- The cargo company: If the truck accident resulted from improperly loaded cargo, the company in charge of loading it can be held liable. These accidents generally involve cargo shifting or spilling.
