When facing an event as joyful as childbirth, the last thing any parent wants to think about is the possibility of medical malpractice. However, knowing what is considered medical malpractice in the context […]
The process of having a child is complex and there are myriad things that can go wrong. Some of those potential hazards, however, can be prevented, provided that the medical staff attending the birthing is attentive and competent. When they’re not, there may be injury to the child that is irreversible and devastating. Among the injuries that may occur is cerebral palsy, a particularly devastating type of brain damage that cannot heal.
Cerebral palsy results from the infant being starved of oxygen at some point prior to or during the birthing process. This can occur for several reasons. In many cases, the child may be injured because of the umbilical cord having strangulated them or because of being placed in a position that choked off their oxygen supply during birth. If this could have been prevented, there’s a chance that you could win a lawsuit. If your child has been diagnosed with a condition such as ataxic cerebral palsy, you should consider finding an attorney. It’s not hard to find someone to represent you.
Cerebral palsy attorneys have experience and expertise in this area of the law. This enables them to provide competent legal counsel from beginning to end. This will start with a consultation. The consultation will be the phase where the attorney determines if you do have a case worth pursuing and how much you could stand to gain from filing the claim. If they believe that your chances are good, they may decide to take you on as a client. This can be done in several different ways, but a contingency agreement is usually the most beneficial for the client.
In a contingency arrangement, the attorney only gets paid if they win a settlement or a jury award for your claim. If your case loses, you’re not on the hook for any money at all. This ensures that the attorneys who pursue these cases only take those cases that they really believe will win. It also allows individuals with few financial resources to get legal representation and to have their cases heard. This is not discount law service. The attorneys are every bit as competent as any other and, oftentimes, they’re very experienced with dealing with cases involving cerebral palsy.
