Delivery drivers are hard-working individuals who are considered by many to be the backbone of America. These workers perform an important job by ensuring the supply and demand chain keeps moving. From delivering dinner to making sure our stores are stocked, our economy depends on drivers. Thus, it's disappointing when one realizes that these men and women are routinely cheated out of an honest wage by their employers.

According to the Fair Labor Standards Act (FLSA), all non-exempt employees who work more than 40 hours in a week are entitled to overtime (calculated at one and a half times normal pay) for any additional time worked.

The FLSA clearly laid out laws that all employers need to follow when it comes to overtime pay. When employers skirt these rules, they open themselves up to a lawsuit. Recently, a Harlem chain of the popular Papa John’s delivery pizza franchise made headlines when workers brought on a class action lawsuit alleging that the chain had been stiffing them of their hard-earned money by rounding off their hourly wages to the nearest increment, not paying workers overtime premiums, as well as failing to reimburse transportation maintenance costs.
In another high profile case, a Texas driver working for office supply retailer Staples filed a lawsuit due to the company’s nonpayment of drivers’ time during the loading of their trucks. Domino’s Pizza has also been caught up in these claims after RPM Pizza (the largest franchise of Domino’s Pizza in the United States) got hit by a class action suit for not reimbursing its workers’ transportation costs.
