Action Lawsuit against debt consolidation and credit counseling
company US Credit Management, Inc.
US Credit Management, Inc. is in the business of “debt elimination
and credit counseling.“ A customer of US Credit Management,
Inc. has filed a class action lawsuit against US Credit Management,
Inc. alleging that it is operating in violation of Federal law
and that it is operating a debt-pooling business in violation of
Texas law.
The following allegations have been made:
· US Credit Management, Inc. solicits consumers
who have incurred substantial amounts of unsecured debt and claims
it will help them become debt free.
· After entering into a contract for services
with US Credit Management, Inc., the consumer is required to provide
the consumer’s total indebtedness, and the identities of
the consumer’s unsecured creditors, including the specific
amount of money owed to each creditor.
· Based on the information provided by
the consumer, US Credit Management, Inc. determines a fixed sum
to be paid by the consumer to US. Credit Management, Inc. on a
monthly basis.
· US Credit Management, Inc. ultimately
attempts to negotiate a reduction in the consumer’s debt
and then distributes the reduced amounts creditors.
The customer has alleged that US Credit Management,
Inc. does not make various disclosures required by the Federal
Credit Repair Organizations Act and that its operations violate
numerous provisions of the Texas
Finance Code and are deceptive trade practices.
